Terms of Use

1. Scope

These terms govern your use of Echoes — the website echoes.study, the web app and the mobile apps (together, the "Service") — operated by Hamideh Sheikh ("we", "us"; contact details in the Imprint). By creating an account you agree to these terms. How we handle personal data is explained in our Privacy Policy.

2. The Service

Echoes helps you learn languages with flashcards, spaced repetition and AI-assisted card creation. The Service is currently free of charge. Because it is free, there is no entitlement to any particular feature or to uninterrupted availability. We may change, extend or discontinue features; if we plan to shut the Service down entirely, we will tell you at least 30 days in advance so you can take what you need.

3. Your account

  • You must be at least 16 years old to create an account.
  • The information you give us must be accurate. Each person may hold one account.
  • Keep your password to yourself. If you suspect someone else has access to your account, change your password and let us know.
  • You can delete your account at any time in the settings.

4. Your content

Decks, cards and other material you create remain yours. So that we can run the Service, you grant us a free, non-exclusive right to store, copy, process and display that content, limited to what the Service requires — for example, to show a shared deck to the people you shared it with, or to everyone if you make it public. This right ends when you delete the content or your account, except for decks that other members continue to use (see our Privacy Policy).

You are responsible for what you upload and share. You may only use content that you have the right to use, and it must not break the law or infringe the rights of others — in particular no copyrighted material you are not permitted to share, no insults, harassment or hate speech, and no personal data of other people without their permission. We may remove content or restrict sharing if we are made aware that it breaches these rules.

5. AI-generated content

Cards, translations and example sentences created with the help of AI can contain mistakes. They are learning aids, not authoritative references; please check anything important.

6. Fair use

When using Echoes you must not:

  • interfere with or overload the Service, or try to bypass security measures or usage limits;
  • access the Service by automated means (scraping, bots) other than through our apps;
  • use the Service to send spam or to distribute malware;
  • use other people's accounts or pretend to be someone else.

7. Liability

We are liable without limitation for damage caused intentionally or through gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence we are liable only if we breach an obligation that is essential to the purpose of these terms and on which you may reasonably rely; in that case our liability is limited to the damage that is typical and foreseeable for a free service of this kind. Otherwise, liability for slight negligence is excluded.

Please keep in mind that data can be lost through technical faults despite our care. If a deck matters a lot to you, keep your own copy of its content.

8. Ending the agreement

You can end this agreement at any time by deleting your account. We can end it with 30 days' notice by email. We may suspend or close an account without notice for good cause, in particular a serious or repeated breach of these terms; where reasonable, we will warn you first.

9. Changes to these terms

We may update these terms, for example when we add features or the law changes. We will tell you about significant changes by email or in the app at least 30 days before they take effect. Changes that affect your rights substantially only apply once you agree to them; if you do not agree, you can keep using the Service under the previous terms until we end the agreement as described in section 8, or delete your account.

10. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of the country in which you habitually reside. If a provision of these terms is invalid, the remaining provisions remain in effect.

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. Questions? Write to privacy@echoes.study.
